Acceptance of Terms

Talent Assessment is a service provided by BeyondSky OÜ, registered in Estonia under company number 16894028. By accessing or using the Talent Assessment platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. If you are using the platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Service Description

TalentAssessment is a B2B SaaS platform that provides psychometric assessment tools for recruitment and employee profiling. Our services include:

• Screening: candidate assessment through validated psychometric questionnaires for recruitment purposes
• Profiling: employee personality and values profiling for team building and organizational development
• Reports: detailed psychometric reports and analytics for recruiters and HR professionals
• Campaign management: tools to create, manage, and track assessment campaigns

Account Responsibilities

When you create an account on our platform, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Prohibited Use

You agree not to use the platform for any of the following purposes:

• Any unlawful purpose or in violation of applicable laws and regulations
• Discriminatory practices in hiring or employment decisions based solely on assessment results
• Reverse engineering, decompiling, or attempting to extract the source code or algorithms of our platform
• Accessing or attempting to access accounts, data, or systems without authorization
• Interfering with or disrupting the integrity or performance of the platform
• Reselling, sublicensing, or redistributing access to the platform without written consent

Intellectual Property

All content, features, functionality, questionnaires, algorithms, reports, trademarks, and other intellectual property on the TalentAssessment platform are owned by TalentAssessment or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during your subscription period. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, TalentAssessment shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the platform. Our total liability for any claims arising from these terms or your use of the platform shall not exceed the amounts paid by you in the 12 months preceding the claim. Assessment results are provided as decision-support tools and should not be used as the sole basis for employment decisions.

Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure. While our assessments are based on validated psychometric methodologies, we do not guarantee specific outcomes or the absolute accuracy of assessment results.

Termination

We may suspend or terminate your access to the platform at any time, with or without cause, upon reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable data retention laws. Any provisions of these terms that by their nature should survive termination shall remain in effect.

Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of the platform after such changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts in Estonia. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
